1. About Pack the Kids

Pack the Kids is a South African platform that helps parents and guardians discover kids' activities, events and venues. The platform is operated by Remote South (Pty) Ltd ("we", "our" or "us"), a company registered in South Africa.

These Terms and Conditions govern your use of:

• The Pack the Kids mobile application (iOS and Android)
• The website at packthekids.co.za
• Any related services we provide

2. Eligibility

By using Pack the Kids, you confirm that:

• You are at least 18 years of age, or using the app under the supervision of a parent or legal guardian
• You have the legal capacity to enter into a binding agreement
• You will use the platform in compliance with these Terms and all applicable South African laws

3. User Accounts

3.1 Registration

To access certain features, you must create an account. You agree to:

• Provide accurate, current and complete information
• Keep your account credentials secure and confidential
• Notify us immediately of any unauthorised use of your account
• Be responsible for all activity that occurs under your account

3.2 Account termination

We reserve the right to suspend or terminate your account if you violate these Terms, engage in fraudulent activity, or use the platform in a way that is harmful to other users or to Pack the Kids.

4. Parent & User Responsibilities

As a parent or user of Pack the Kids, you agree to:

• Use the platform only for lawful purposes related to finding kids' activities
• Not post false, misleading or defamatory reviews or content
• Not harass, abuse or harm other users or hosts
• Verify activity details directly with the host before attending — information may change
• Supervise your children at all activities; Pack the Kids is not responsible for on-site supervision
• Not attempt to reverse-engineer, scrape or misuse the platform

5. Host & Venue Responsibilities

If you register as a host or venue on Pack the Kids, you additionally agree to:

5.1 Accuracy of listings

• Provide accurate, up-to-date information about your activity, event or venue
• Promptly update your listing if details change (prices, hours, availability)
• Not misrepresent your offering or use misleading imagery

5.2 Compliance

• Ensure your activity or venue complies with all applicable South African laws, safety regulations, health requirements and insurance obligations
• Hold all necessary licences and permits required to operate your activity
• Be responsible for the safety and wellbeing of children attending your activities

5.3 Bookings & enquiries

• Any bookings or payments are made directly between parents and hosts — Pack the Kids is not a party to these transactions
• Pack the Kids is not responsible for any disputes between parents and hosts
• You are responsible for responding to enquiries in a timely and professional manner

5.4 Listing removal

We reserve the right to remove any listing that violates these Terms, contains inappropriate content, or that we determine in our sole discretion is not suitable for the platform.

6. Content & Intellectual Property

6.1 Your content

By submitting content to Pack the Kids (including listings, photos, reviews and event descriptions), you grant Pack the Kids a non-exclusive, royalty-free, worldwide licence to use, display and distribute that content on the platform for the purpose of operating and promoting Pack the Kids.

You confirm that you own or have the rights to all content you submit, and that it does not infringe any third-party rights.

6.2 Our content

All content on the Pack the Kids platform (including branding, design, code and editorial content) is owned by Remote South (Pty) Ltd and protected by copyright. You may not reproduce, distribute or create derivative works from our content without written permission.

7. Prohibited Content

You must not submit any content that:

• Is unlawful, harmful, threatening, abusive or defamatory
• Infringes the intellectual property rights of any person
• Contains sexually explicit material or content inappropriate for families
• Constitutes spam or unsolicited commercial communications
• Contains malware, viruses or other harmful code
• Discriminates against individuals on the basis of race, gender, religion, disability or any other protected characteristic under South African law

8. Third-Party Services & Links

Pack the Kids integrates with or links to third-party services including Mapbox (maps), Supabase (database), RevenueCat (subscriptions) and Google AdMob (advertising). Use of these services is subject to their own terms and privacy policies. Pack the Kids is not responsible for the practices of these third parties.

Links to external websites (including host websites) are provided for convenience only. We do not endorse or take responsibility for the content of external sites.

9. Subscriptions & In-App Purchases

Pack the Kids may offer premium features through paid subscriptions or in-app purchases. Where applicable:

• Subscriptions are managed and billed through the Apple App Store or Google Play Store
• Subscription terms, pricing and cancellation policies are governed by Apple's or Google's terms of service
• Refunds are subject to the App Store or Google Play refund policies
• We reserve the right to change pricing with reasonable notice

10. Disclaimer of Warranties

Pack the Kids is provided on an "as is" and "as available" basis. To the maximum extent permitted by South African law, we disclaim all warranties, express or implied, including:

• That the platform will be uninterrupted, error-free or secure
• That activity listings are accurate, complete or up to date
• That any activity, event or venue listed on the platform is safe, licensed or suitable for your children

It is your responsibility to verify all information with the relevant host before attending any activity.

11. Limitation of Liability

To the maximum extent permitted by law, Remote South (Pty) Ltd shall not be liable for:

• Any indirect, incidental, special or consequential damages
• Any loss of data, revenue or business opportunities
• Any injury, harm or loss suffered at or in connection with an activity listed on the platform
• Any disputes between parents and hosts
• Any unauthorised access to your account due to your failure to keep credentials secure

Our total liability to you in any circumstances shall not exceed the amount you paid to Pack the Kids in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Remote South (Pty) Ltd and its directors, employees and agents from any claims, damages, losses or costs (including legal fees) arising from your use of the platform, your content, or your violation of these Terms.

13. Privacy

Your use of Pack the Kids is also governed by our Privacy Policy, which forms part of these Terms and Conditions. By using Pack the Kids, you consent to the collection and use of your information as described in the Privacy Policy.

14. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes via the app or by email. Continued use of Pack the Kids after changes are posted constitutes your acceptance of the updated Terms. The "Last updated" date at the top of this page always reflects the most recent revision.

15. Governing Law & Disputes

These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from or in connection with these Terms or your use of Pack the Kids shall be subject to the exclusive jurisdiction of the South African courts.
